Terms of Service

1. Introduction and Acceptance of Terms

These Terms of Service (the “Terms”) govern access to and use of the services, programs, facilities, communications, websites, portals, and related offerings provided by Maple Grove Learning Academy (“Maple Grove,” “we,” “us,” or “our”).

Maple Grove Learning Academy is located at 1420 Maple Grove Road, Ottawa, ON K1A 0B1, Canada.

By enrolling in, registering for, accessing, or using any of our services, or by submitting any application, form, payment, or other information to us, you acknowledge that you have read, understood, and agree to be bound by these Terms and by any policies, notices, schedules, or program-specific rules referenced herein. If you do not agree, you must not use our services.

If the user is under the age of majority in Ontario, a parent or legal guardian must review and accept these Terms on the student’s behalf and is responsible for all obligations arising from the student’s participation.

2. Scope of Services

Maple Grove provides educational services that may include, without limitation:

  • Elementary education;
  • Middle school programs;
  • After-school tutoring;
  • STEM enrichment classes;
  • French language instruction;
  • Homework support; and
  • Student assessment and progress reporting.

Services may be delivered in person, online, or in a hybrid format, depending on program availability, scheduling, staffing, public health guidance, and operational considerations.

We may modify curricula, class schedules, instructors, assessment methods, class sizes, and service delivery formats at our discretion, provided that any material changes are communicated in a reasonable manner.

Unless expressly stated otherwise in writing, Maple Grove does not guarantee specific academic outcomes, grades, admission results, language proficiency levels, or standardized test scores.

3. User Obligations and Responsibilities

Students, parents, guardians, and other users of our services agree to:

  • Provide accurate, current, and complete information during registration and throughout the relationship;
  • Promptly update us regarding changes to contact details, emergency contacts, medical considerations, custody arrangements, or other relevant information;
  • Ensure timely attendance and participation in scheduled classes, assessments, and tutoring sessions;
  • Comply with all academic, behavioural, safety, and attendance policies communicated by Maple Grove;
  • Treat staff, instructors, students, and property with respect and refrain from disruptive, abusive, discriminatory, harassing, or unsafe conduct;
  • Follow all applicable laws, regulations, school rules, and public health requirements;
  • Obtain and maintain any required permissions, consents, or authorizations for participation, including where applicable consent for field trips, online learning platforms, or student support services;
  • Ensure that any devices, internet access, software, or materials required for online or hybrid services are available and functioning as needed; and
  • Not misuse, copy, distribute, reverse engineer, or interfere with our materials, systems, or services.

Parents and guardians are responsible for supervising minors outside of scheduled program hours and for ensuring that students are collected safely and on time where applicable.

Maple Grove reserves the right to suspend or terminate access to services for any student or user whose conduct, in our reasonable judgment, poses a safety risk, disrupts learning, violates these Terms, or is otherwise inappropriate.

4. Payment Terms and Conditions

Fees for tuition, tutoring, enrichment classes, assessments, materials, registration, late pickup, administrative services, or other charges will be communicated at the time of registration, in a fee schedule, invoice, or program agreement.

  • All fees are due in accordance with the payment schedule provided by Maple Grove.
  • Unless otherwise stated, fees are quoted in Canadian dollars (CAD).
  • Applicable taxes, including GST/HST where required by law, may be added to the stated fees.
  • Payments may be required in advance, by installment, or upon invoice, depending on the program.
  • Late or failed payments may result in suspension of services, withholding of reports, denial of re-enrollment, or other reasonable administrative measures permitted by law.
  • Any returned payment, chargeback, or failed transaction may be subject to an administrative fee to the extent permitted by applicable law.

Unless expressly agreed otherwise in writing, fees are non-transferable and apply only to the registered student and selected program.

Maple Grove may revise fees for future terms or programs by providing reasonable notice. Fee changes will not apply retroactively to services already paid for, except where required by law or expressly agreed.

5. Cancellation and Refund Policy

Cancellation and refund rights may vary depending on the type of service, the timing of cancellation, and whether materials, staffing, or reserved spaces have already been allocated.

  • Program registration: Registration fees may be non-refundable unless otherwise stated in writing.
  • Tuition and recurring services: Cancellations must be submitted in writing to the contact information listed below.
  • Before commencement: If a cancellation is received before services begin, a refund may be issued less any non-refundable deposits, administrative fees, or costs already incurred, where permitted by law.
  • After commencement: Refunds for services already delivered are generally not available, except where required by applicable consumer protection law or where Maple Grove determines, in its discretion, that a partial refund is appropriate.
  • Missed classes or sessions: Missed sessions due to student absence are not automatically refundable or transferable.
  • Instructor or schedule changes: Maple Grove may offer make-up sessions, credits, or alternative arrangements where reasonably possible, but is not obligated to do so unless required by law or a written program policy.

Any refund issued will be processed using the original payment method where practicable, within a reasonable time after approval. Refunds may be subject to deductions for services rendered, materials provided, third-party costs, and administrative expenses, to the extent permitted by law.

Nothing in these Terms limits any non-waivable rights under applicable Canadian or Ontario law, including rights that may arise under consumer protection legislation where applicable.

6. Liability Limitations

To the fullest extent permitted by applicable law, Maple Grove, its directors, officers, employees, contractors, instructors, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, loss of data, loss of opportunity, or loss of goodwill, arising out of or related to the use of our services.

To the fullest extent permitted by law, our total aggregate liability for any claim arising out of or relating to the services or these Terms shall not exceed the amount paid by the affected user for the specific service giving rise to the claim during the three (3) months preceding the event giving rise to the claim, or CAD $500, whichever is greater, except where such limitation is prohibited by law.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for gross negligence, wilful misconduct, fraud, or death or personal injury caused by negligence where such exclusion is prohibited.

Educational services involve inherent limitations and depend on many factors outside our control, including attendance, effort, home support, and student circumstances. We do not guarantee uninterrupted service, error-free materials, or specific academic results.

7. Intellectual Property Rights

All content, materials, lesson plans, worksheets, assessments, reports, logos, trademarks, designs, text, graphics, audio, video, software, and other intellectual property provided by Maple Grove or used in connection with our services are owned by Maple Grove or its licensors and are protected by Canadian and international intellectual property laws.

Subject to compliance with these Terms and full payment of applicable fees, Maple Grove grants users a limited, non-exclusive, non-transferable, revocable license to access and use our materials solely for personal, non-commercial educational purposes related to the enrolled student’s participation in our services.

Users may not, without our prior written consent:

  • Copy, reproduce, distribute, publish, sell, license, or exploit our materials;
  • Record classes, sessions, or communications where prohibited by policy or law;
  • Remove proprietary notices or branding;
  • Use our materials for commercial tutoring, training, or publication;
  • Modify or create derivative works from our materials except as expressly permitted.

Any feedback, suggestions, or ideas submitted to Maple Grove may be used by us without restriction or compensation, unless otherwise prohibited by law.

8. Data Protection and Privacy

Maple Grove collects, uses, discloses, and retains personal information in accordance with applicable Canadian privacy laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA) and, where applicable, Ontario privacy and education-related requirements.

Personal information may include student, parent, guardian, emergency contact, academic, attendance, billing, health, and support information necessary to provide educational services, maintain safety, communicate with families, manage accounts, and comply with legal obligations.

We may use personal information to:

  • Register and manage student enrollment;
  • Deliver educational and support services;
  • Assess progress and prepare reports;
  • Communicate with parents, guardians, and authorized contacts;
  • Process payments and administer accounts;
  • Maintain safety, discipline, and operational records;
  • Meet legal, regulatory, insurance, and audit requirements; and
  • Improve our programs and services.

We may disclose personal information to service providers, instructors, payment processors, technology vendors, and other third parties only as reasonably necessary to operate our services, subject to confidentiality and security safeguards, or where required or permitted by law.

We take reasonable administrative, technical, and physical safeguards to protect personal information. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.

Where required by law, individuals may request access to or correction of their personal information by contacting us using the details below. Requests may be subject to verification and lawful exceptions.

If our services use online platforms or third-party tools, users acknowledge that those services may be subject to separate terms and privacy policies. We are not responsible for the privacy practices of third-party providers except as required by law.

9. Force Majeure

Maple Grove shall not be liable for any delay, interruption, suspension, or failure to perform its obligations where such delay or failure results from events beyond our reasonable control, including but not limited to:

  • Severe weather;
  • Fire, flood, or natural disaster;
  • Power outage or utility failure;
  • Labour disputes or strikes;
  • Government action, emergency orders, or changes in law;
  • Pandemics, epidemics, or public health emergencies;
  • Cyberattacks, internet outages, or telecommunications failures; and
  • Other similar events beyond our reasonable control.

In such circumstances, we may suspend, modify, reschedule, or replace services, including by moving to remote delivery where feasible. We will make reasonable efforts to minimize disruption.

10. Changes to Terms

Maple Grove may update or revise these Terms from time to time to reflect operational, legal, regulatory, or service changes. The revised Terms will be posted or otherwise communicated with a new effective date.

Continued use of our services after the effective date of revised Terms constitutes acceptance of the updated Terms. If you do not agree to the changes, you must discontinue use of the services and, where applicable, cancel enrollment in accordance with the cancellation policy.

11. Applicable Law and Jurisdiction

These Terms and any dispute, claim, or controversy arising out of or relating to them, or to the services provided by Maple Grove, shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Subject to any mandatory consumer or education law rights that cannot be waived, the parties agree that the courts located in Ottawa, Ontario shall have exclusive jurisdiction over any dispute arising from or related to these Terms or the services.

13. Severability Clause

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court or competent authority, that provision shall be severed or modified to the minimum extent necessary to make it valid and enforceable, and the remaining provisions shall continue in full force and effect.

The failure of Maple Grove to enforce any right or provision under these Terms shall not constitute a waiver of such right or provision unless acknowledged in writing by Maple Grove.

These Terms constitute the entire agreement between Maple Grove and the user regarding the subject matter herein, except as supplemented by any signed enrollment agreement, program policy, or other written agreement expressly incorporated by reference.
